As in every covenant recorded in the Bible, David and Jonathan "made a covenant". That is to say it was mindful and willfully entered into by both parties. It's never something stumbled into between equals.
We don't have any record of a man and a woman entering a similar covenant before (or after) a marriage. If there is a case, no one has introduced it to this thread.
Exodus 24:3, 7 indicate the people agreed. Now, clearly they didn't negotiate the terms, but it is not a unilateral covenant. In theory they could have turned it down, but after Ex. 20:18, fear and awe were clear motivators to accept unconditionally.This is part of the misunderstanding I think. It’s not a covenant between “equals” the woman does not have that authority to enter into the covenant. Her father does. Basically the maintenance of the “covenant” is dependent on the husband. When God makes a covenant with a man I cannot remember any instance where the man has a choice in the matter. The man or nation is simply informed of the covenant. God has the role of both father and husband.

We cannot mix the two moral codes! One calls for an oath to make a sacred vow, the other simply calls for loyalty toward a wife once taken.
What is fornication? Disloyalty or unfaithfulness.
It is not just sexual as shown by texts such as Num 14:33, (Whoredoms KJ, Unfaithfulness NIV) Judges 19:2, (played the Whore gainst him, KJ Unfaithful to him NIV) Ezek 6:9, (Whorish heart KJ adulterous hearts NIV) These texts are speaking of unfaithfulness but are not in reference to sexual conduct.

That's the way the Bible presents it....He doesn't have to command us to make a covenant, nor does there seem to be anywhere that an explicit covenant must be made inorder to be man and wife.
Why? Because the expectations areknown, and we are seeking to followGod's heart for us as men/wives,rather than making vows (whichJesus DOES specifically tell us not todo).
As in that passage @Pacman seems to dismiss (not sure why? Your argument about not being under headship seems to be a non-related topic considering that whether the woman was under headship or not, God now declares them man and wife... still no explicit covenant bro...), God can view man and wife as man and wife without an explicit covenant. Why? Because it's a matter of identity, just like being parents/children.
Jacob thought he was marrying Rachel, we don't know what precise form that agreement took, and it may well have not applied to Leah at all. They may have had no covenant when he slept with her.
BUT, once he figured out who she was, he had now taken her virginity and had an obligation to keep her anyway - to agree to take her from her father and have her as his wife. That agreement with her father, whether spoken or unspoken, and despite being entered unwillingly, was still an agreement or covenant. By contrast, if he had run off the next morning and abandoned Leah, he'd have slept with her without taking her as a wife as he was obliged to do - and sinning.
So in Leah's case, sex came first, agreement / covenant came second.
In Rachel's case, the agreement came first (entered into honestly and openly), sex came second.
Both ways formed equally valid marriages.
