Not all families are created equal, moral, or intelligent enough to see the destruction that could be caused to the innocent in their own family. As a parent, I could not justify allowing a prepubescent child to be married off in polygyny or monogamy. Some things are off limits and sacred enough to pass laws against.
1) Laws can be enforced without government. Read old testament law. There is no government there.Nobody does. But the individual parent willing to marry off their young or mentally challenged child usurps the rights of that child. Society and governing are tricky.

Yes, by the consent of the governed, we deputize officers of the laws we establish to enforce societal morality (in this instance, child marriage a mentally challenged marriage).Some of us still, "hold these Truth to be self-evident."
