The False Imprisonment of Tresa Moore

Her name is Tresa. Since I refuse to go asking the state for permission to marry since that is God's to give, we are not legally married, so her legal name is Tresa Moore. She stood up to her sister who is a lesbian, and who has openly come against our belief in polygamy, because her sister wanted to teach Cheyenne, Tresa's daughter about homosexuality, and we taught Cheyenne what Scripture says. They have hired a PI to tail us, tailed us themselves, dug through our financial paperwork we had stored, physically threatened me, and threatened 2 years ago to have Tresa thrown in jail. We have had to go through 2 rounds of CPS visits because they filed charges related to our religious beliefs and sexually abusing Cheyenne, which both times were found to be false.

So her sister, a Prison guard in Rusk, Texas, had charges trumped up throwing Tresa in jail, where she has been since 7/9/09. We do not have the money for a lawyer, and so she has a court appointed one who is know all over the world for the cases he lost (Google Thad Davidson). She has filed at least two PR Bond requests (her bond is set at $35,000) to be denied. I was thrown out of the DA's office and told there was no way they were letting her out and that she will go to prison for the max (10 years). He told me that she should, "Render unto Caesar that which is Caesar's" as to justification for her being treated the way she has been. She has spent the entire time preaching and teaching in the jail, and there are several inmates that are studying with her and she leads in worship. They are asking for the Bible which Tresa uses (The Hebrew Greek Key Word Study Bible KJV and not the 2008 edition) and for me to send more sermons. They are talking about moving 160 miles to the west to fellowship with us when they get out. There is no certificate of marriage, so no bigamy charges, but in Texas, just claiming someone is your spouse is common law marriage, and that can be charged as bigamy as well. You prayers are greatly appreciated, and if you know of a Biblical polygamy friendly lawyer who would take her case, that would be great as well. I set up a cause on Facebook so that I can keep everyone informed of everything that has happened.

A little additional details on this: She was taken into court last Tuesday (9/8/09 opn a PR Bond hearing, but for some reason (she did not understand the legal talk they were using) the hearing had to be postponed, and she was told that it would be held in the next couple of days. It has been over a week and no further hearing. The ADA, Richard Kennedy, lied to me twice, to my face, and also told me that he was in the judgment business. When I started to bring up 1 Corinthians 6, he quickly shut me up and threw me out.

I have talked to her attorney, Thad Davidson, twice directly. The first time, he argued with me saying that the ADA was an honorable man, and told me to never talk Bible with him because he is not interested. He told me not to tell him how to do his job. But he tried telling me to do mine. The other time, he said that he was going to go to file a PR Bond request, but I do not know if he did that. He kept telling Tresa to not have me call her. Then one day, she told me over the phone, that she had to pay for this "court appointed attorney". I told her that the State has to pay him but she said she was told she had to. So I called Mr Davidson again, and again got his voice-mail (He will not pick up if I call). i told him that if Tresa had to pay, then I was the one paying, and if I am paying him, then he better give me a call and discuss her case. He begged Tresa at that point to not say anything about paying him, because she owed him nothing, and that he cold get into big trouble if I talked about paying him. Then, Tresa was given the impression from her lawyer that if I called again, he would not represent her very well.

In this situation (although I have been in a similar situation myself) I will avoid any "attempt to give legal advice". However, given your comments, I would ask a question like, "what kind of 'representation' is possible from someone who lies, will not do as asked, appears incompetent, and - to top it all - denies God?"

Could doing without such "help" be any worse?

So my advice from the perspective of a fellow Believer in Him is to put your faith in God, not in men.

I looked up this topic and found many people against it. But then I found that there is a case of a woman, also by the name of Tresa Moore, who burned the fingers of a boy in Ohio. As this is spoken of as Texas, people are obviously confusing the two cases, and seem to be rejecting what is written about it because of that. You might want to clarify that this is not the Tresa Moore case in Ohio.

Good catch, Sadan. I think the one in Ohio is spelled "Teresa Moore", rather than "Tresa", but they both showed up on the same page of Google Returns.

Btw, Scott ... I'm so sorry for all y'alls, and will definitely hold you up in prayer.
 
Thank you for the information. I actually had prayed, and when we got a new phone book, I opened it up and it rested on a page that had attorneys on it and one said that they worked with Christian legal services. I gave her a call, and went in to talk with her on a free consultation. We spoke for almost an hour, she said she would pray on it, then sent me a contract that said for me to pay $3,00 down and $500 a month til the bill was paid off. I told her in her office that we did not have the money to hire a lawyer, and again I let her know afterwards that we did not have the money, but that I would pray and see if He blessed us with the money.

What we were given was telescope equipment, said to be worth $3,500, but which no one around here will buy, and Ebay wants money to sell the stuff. The lawyer said she believed He answers prayers and that she would pray too. After a few weeks, I talked to her again, saying that I had the equipment, but otherwise, no money. She said she would pray about it and get back to me, which I have never heard back from her. I even contacted the North Texas Astronomy club, but none of them said that they wanted the equipment. The lawyer I talked to said the statute of limitations for what she is charged with was 2 years, and that it may have expired before they filed the charge against her. I told Tresa about that, and her lawyer said he did not know what the statute of limitations was, but that he thought it was 7 years.

I believe that the Lord will set her free and exonerate her, and now am just waiting on Him to do that. Being mocked and turned away when I went to see if I could get her out on a PR Bond, it felt like Moses going before Pharaoh saying "the Lord says, 'Let My people go!'" I did get to see Tresa, even though they changed the rules and visitation times. When I called, since I am a pastor, they told me I could come anytime and I was not restricted to how long I could see her. But when I showed up, they said I was supposed to see her during visitation hours and for only 20 minutes. They let me in because they had told me I could come any day, but just that one time, and gave me only 20 minutes to see her. Years ago, when I di Prison ministry in Mississippi, I was allowed to go in and sit down and talk with the inmate without having the glass separating us. This time, though, they made me sit on the other side of the glass and use the phone to talk to her.

What few connections I have, either they flat out refused to help me, or they say they will help me, and then they stop talking with me. The one thing I know is that Tresa is busy there holding Bible studies and worship services for the inmates. I sent them some lessons, and she has said that they women are asking for more lessons and bibles. Since I have not been able to work on her defense, I have just been working on the spiritual aspect and helping Tresa to teach and reach the other inmates. My hope is that she can lead many of those inmates to the Lord. i pray that He continues to give her the boldness to proclaim the Gospel to them, and that He provides me with the things that she and the women need to help them along their path.
